Following the Trump Administration announcement earlier this year that the controversial WOTUS (Waters of the United States) rule would be withdrawn, the Environmental Protection Agency (EPA) and the Army Corps of Engineers (Corps) have proposed a rule to push out the effective date of the rule two years ahead to delay issuing a revised rule.
Time is running out as the Supreme Court is slated to consider whether the 6th Circuit Court acted properly to stay the controversial rule. EPA and the Corps published a second notice soliciting suggestions for re-drafting the rule. NMHC is a as founding member organization of the Waters Advocacy Coalition and supported comments that highlighted the need for states to assert primary authority over land and water use.
