The FCC recently issued a new rule that impacts the type of agreements that multifamily firms and broadband providers can enter into. The new rules:
- Prohibit broadband providers from entering into graduated revenue sharing agreements or exclusive revenue sharing agreements with a building owner;
- Require broadband providers to disclose to renters if an exclusive marketing arrangement is in place with the building owner;
- Clarify that existing rules prohibit sale-and-leaseback wiring arrangements.
This is an issue the multifamily industry has been closely monitoring for the past several months because of its potentially negative impacts on the industry.
