The Clean Water Act (CWA) protects the quality of the nation’s waters, including its lakes, rivers, wetlands and more, by regulating how many pollutants properties can discharge. NMHC believes, however, that expanding the scope of the Clean Water Act would result in undue federal regulatory requirements for apartment firms. Read our Issue Fact Sheet.
Policy Updates
On July 24, NMHC joined a coalition of 45 industry stakeholders in a letter calling for a thorough rewrite of the Waters of the U.S. Rule (WOTUS) by the EPA and Army Corps of Engineers. Property owners secured a victory earlier this year when the Supreme Court recognized limits to federal jurisdiction under the Clean Water Act (CWA) in Sackett v. EPA.
